Draft letter of resignation

An employee who decides to resign from his job must notify his employer in advance of this intention, by means of a letter of resignation.

Rules for writing a letter of resignation

  • For: Name of employer, company / human resources department
  • Date of submission of the letter
  • Subject: Notice of termination of employment
  • At the beginning or end of the letter: It is advisable to write a few kind words that express appreciation for the workplace
  • Reason for termination of employment: It is not obligatory to state the reason, but it is especially worthwhile in cases where the reason meets the criteria of entitlement to compensation under the law (detailed below)
  • Actual end date: The law of prior notice of resignation must be taken into account (will be detailed below)
  • Additional rights: You can request in a letter to regulate the rights according to the employment agreement, such as redemption of vacation days, compensation, etc.
  • At the end of the letter, you can indicate a request for a letter of recommendation
  • It is advisable to end the letter with a personal tone and a greeting of success
  • The letter can be placed in the mailbox or placed on the desk of the incumbent, but it is even more desirable to schedule a short meeting with the employer in which to submit the letter of resignation.

The letter should be drafted properly and not vindictively, and end the employer-employment relationship in good spirits as there is a possibility that the fired person will need the services of the employer later on (like a letter of recommendation or a desire to return to work at a later stage).

Reasons for resignation entitling to compensation

There are a number of grounds for resignation for which the resigning person is entitled to receive compensation as if he had been fired.

  • Postpartum resignation: Nine months after birth, a father or mother may resign from their job for the purpose of caring for the baby and are entitled to compensation from work as if they had been fired from it.
  • Resignation for the purpose of caring for a child: Parents may move to a new workplace where the hours are more convenient, thus justifying the resignation for the purpose of caring for the child
  • Resignation due to illness of the employee or a relative
  • Voluntary resignation due to violation of terms of employment
  • Resignation due to joining the police, the IDF or the Prison Service
  • Resignation due to moving to another city (usually at a distance of 40 kilometers or more).

Notice of resignation

  • The notice period for resignation is an outgrowth of two main parameters:
  • Type of salary: monthly or hourly
  • The period in which the employee was employed
The following is a calculation of the notice period for an employee with a monthly salary:
  • Employee who worked up to six months - one day's notice for each month of work
  • Between half a year and a year - 6 days notice for the first half year and two and a half days for each additional month.
  • Employee who has worked for more than a year - one month's notice.
The following is the calculation of advance notice to the employee by hours:
  • Employee who worked up to a year - one day's notice for each month
  • Up to one year to two years - 14 days at least and one day for every two months in the second year
  • More than two years - at least 21 days notice plus a day for every two months of work in the second year
  • Over three years - a month
